In assessing a court decision, particularly in cases of corruption, a legal framework based on national legislation is required, while also taking into account international legal principles and applicable constitutional guarantees. In cases involving business activities with complex economic variables, caution is needed in assessing elements of loss, to avoid a shift between inherent business risk losses and losses resulting from legal violations that should constitute the object of criminal liability. This book focuses on a number of legal issues grouped into several clusters: criminal law and criminal procedure, civil law, corporate law, and public finance law. The discussion focuses on assessing the accuracy of the Panel of Judges’ application of the law. This book was compiled by experts and academics with expertise in law and the criminal justice system, with the support of research assistants who played a crucial role in data collection, legal material processing, and analysis.
